Your data protection rights.

We thought it would be helpful to set out your rights under the relevant data protection legislation.

  • Your right of access – You have the right to ask us for a copy of your personal information. The Information will be provided to you within one month (unless the request is complex). There will only be an additional charge for this if we feel your request is unjustified or excessive.

  • Your right to data portability – This only applies to information you have given us. You have the right to request a copy of your personal information in a commonly used electronic format.
  • Your rights in relation to automated decision making and profiling – If a decision is made about solely about you by automated means, you have the right to request that this decision is reviewed by a human.
  • Your right to withdraw consent – If you originally gave us consent to process your information, you can withdraw this consent at any time. If you do withdraw your consent, we may not be able to provide certain products or services to you. We will inform you if this is the case.

What information do we need to collect about you and why?

To enable us to provide you with an insurance quotation for our products and to administer any insurance policies you have with us, we need to collect your personal information such as:

  • Your name, address and contact details.
  • Name and date of birth of any additional insured parties.
  • Property information.
  • Information about your business.
  • Financial information.
  • Other information that may be required to allow you to participate in promotions and market research, and to allow you to use our websites

Your personal information may be stored electronically, on paper, or as part of a telephone call recording. Which allows us to stay in touch with you and meet our contractual requirements under the policy.

If you fail to provide the information, it may mean that you are unable to exercise your contractual rights, including claiming under the policy. This would also hinder our ability to administer your insurance policy.

On occasion we could ask for special personal information (also known as special category data), we have a legitimate interest to collect this information as it will form part of your insurance quotation or insurance contract. We may also process the information where it is necessary for a legal obligation, or as part of the establishment or defence of a legal claim.

  • Details relating to health or medical conditions.
  • Any unspent offences or criminal convictions of you or somebody else covered under your policy.

We recognise that special personal information may be particularly sensitive. We’ll ensure that we only use that information where needed for our insurance purposes.

We may collect personal information about you from third parties such as:

  • A joint or additional insured party may collect information about you from the policyholder.
  • Fraud prevention, law enforcement or government agencies and other data sources used to prevent or detect fraud or provide details to us about criminal convictions or offences.
  • HM Treasury and other authorities in relation to regulatory issues e.g. checking against the HM Treasury’s asset freezing list for individuals that are subject to financial sanctions.
  • Vulnerability data. Information about health, life events, resilience and capability that helps us identify if you need additional support requirements to support your needs.
  • If a claim is made, we will collect personal information about the claim from any relevant third parties.

This is not an exhaustive list and in specific instances, we may collect more personal information than stated above.

How do we use the information collected?

To provide insurance services; where you request to purchase an insurance policy direct from us, your Broker or Appointed Representative we may also use the information collected to;

  • Deal with complaints.
  • Help prevent and detect crime (for example, the prevention or detection of fraud).
  • Comply with a legal or regulatory obligation and/or assist our regulators.
  • Check whether you are listed on the HM Treasury’s list and as a result prohibited from certain activities or industries.
  • Recover debt.
  • Inform you about and promote products (you can opt out of marketing at any time).
  • Improve our products and services and deliver a better experience in the future.

How long do we store your information?

Your personal information may be stored electronically, on paper, or as part of a telephone call recording.

As a rule, we will keep your personal information for seven years following the end of your relationship with us, as it is likely that we will need the information for regulatory reasons or to defend a claim. However, there may be exceptions where we need to keep your personal information for longer, such as where your policy contains liability cover.

We will also retain information in an anonymous form for statistical and analytical purposes. Following the end of the data retention period, your personal information will be securely destroyed.

Sharing your information

Your information may be shared with the following categories of third parties.

  • Within our group of companies, our agents, and third parties who provide services to us.
  • Insurers/ Reinsurers.
  • Claims third party administrators.
  • Complaints third party administrators.
  • Organisations, including parties they are contracted with, who provide a service related to the insurance policy.
  • Loss adjusters.
  • Regulatory authorities.
  • Fraud prevention agencies.
  • Legal or crime prevention agencies.
  • The Claims and Underwriting Exchange Register (CUE) and the Motor Insurance Anti-Fraud and Theft Register (MIAFTR), where the data is controlled by the Motor Insurers’ Bureau, and other relevant databases.
  • Employer Liability Tracing Office (for commercial policies containing employer’s liability cover).
  • Any additional insured parties who may communicate with us on your behalf if they have your permission.

Is your information shared outside of the UK?

Your personal information may be transferred outside the UK and the European Economic Area. When transferring your personal information out of the EEA, we will do our best to ensure a similar level of security by ensuring that:

  • We transfer your personal information to countries that have been deemed to provide an adequate level of protection by the European Commission or seek assurances for the protection of your information.
  • In the case of providers based in the United States, we may transfer your personal information to them if they are part of the EU-US Privacy Shield. This is an approved framework that requires them to provide similar protection to personal information shared between the Europe and the US.

An example of when we share information outside of the UK is when you opt in to receiving email updates from us. Your personal information is stored on the secure servers of US-based third-party email provider, MailChimp (owned by The Rocket Science Group LLC). We use MailChimp to distribute marketing emails to our subscribers.

MailChimp is fully compliant with the EU-US Privacy Shield Framework. This means that they are certified to receive data from Bspoke Lifestyle Ltd. Bspoke Lifestyle Ltd is deemed the ‘Data Controller’ and MailChimp the ‘Data Processor’. When do we make automated decisions about you?

When you give us your information, our Underwriters or computer systems may make automated decisions about you. The decisions made about you are based on what types of risk that we can insure. The automated decision may impact the level of premium you will pay or the type of product that we can offer to you.

How do we protect your information?

We take the security of your information seriously.  We have internal policies and controls in place to try to ensure that your information is not lost, accidentally destroyed, misused, or disclosed, and is not accessed by unauthorised individuals.

We process your personal information in accordance with the relevant data protection legislation; this includes the UK General Data Protection Regulation, the Data Protection Act 2018, and the Privacy and Electronic Communications Regulations 2003.

Paying monthly for your insurance

If you choose to spread the cost and pay using a monthly direct debit, you will be entering into a credit agreement with a third party, Close Brothers Premium Finance (CBPF).  When you apply for a credit limit you must also be able to afford and sustain the minimum monthly payments. CBPF may use credit scoring and automated decision-making systems.

CBPF will use your personal information to:

  • Assess your application for credit.
  • Verify your identity.
  • Prevent fraud and money laundering.

Marketing preferences

At the time when we collected your personal information, to provide you with an insurance quotation and/or arrange your contract of insurance, we asked you to indicate your marketing preferences.

If you have opted in to receive marketing, we may use your personal information to offer you suggestions about products and services that you might want to buy. The suggestions will be relevant to you, and it will be part of providing you with the right information at the right time and looking at ways that we can extend our relationship with you.
